Terms and Conditions of Use

1.Introduction

Please read these Terms and Conditions of Use carefully before downloading or using the SBC+ Service.

These terms and conditions, along with our Privacy Policy, govern your use of the Seychelles Broadcasting Corporation’s OTT Platform and Services, called SBC+.

By using the SBC+ Applications and Services from the Seychelles Broadcasting Corporation (SBC), you have agreed to these Terms and Conditions of Use.

If you disagree with any of these Terms and Conditions of Use, you must discontinue your access to your use of SBC+ and of the services it offers.

The SBC may change and update these Terms and Conditions of use from time to time. (Refer to Section 16)

2.License to Use

a) If you are aged sixteen or under, you must seek the permission of a parent or guardian before accessing or using this Service.

b) If you are not the owner or the bill payer for the device being used to access and use SBC+, it will be assumed that you have received permission from the owner or bill payer for you to do so.

c)The Applications and the Services offered are for your personal use only and must not be used for business and commercial, purposes.

3.Registration

a) You must register to be able to uses the Applications and Services on SBC+ .

b) Registration is via the SBC+ selfcare portal.

c) When you register, we will request that you to provide us with certain personally identifiable information, including but not limited to Name, Email, Phone Number.

d) The information that we request will be retained by us and used as described in our Privacy Policy.

e) You must provide accurate and complete information when you It is your responsibility to ensure that such information is up to date, and we accept no liability in the case of out-of-date information.

i) We reserve the right to contact you by phone or email, as provided at the time of registration, regarding your use of any forums and other interactive areas of the SBC+ service.

4.Internet Connectivity and Data Usage

a) To use the Applications and the Services offered by SBC+, you will require Internet connectivity and appropriate telecommunication links.

b) You acknowledge that the terms of agreement with your respective Internet Service Provider will continue to apply when using SBC+.

c) As a result, you may be charged by your Internet Service Provider for access to network connection services for the duration of the connection while accessing SBC+ or any such third-party charges as may arise.

5. Community Guidelines: Objectionable Content

The Seychelles Broadcasting Corporation (SBC) prohibits anyone using the SBC+ service from engaging in objectionable activities.

Users’ messages may be removed, or their account may be suspended if their content is found to violate our Terms & Conditions of Use.

Without limitation, you undertake not to use or permit anyone else to use SBC+ Applications and the Services to:

  • make posts or comments that are defamatory, indecent, abusive, threatening, or infringe the copyright, privacy or other rights of third parties,
  • post messages which contain illegal or otherwise unlawful material,
  • post messages which contain viruses or code which may cause damage to another user’s computer software or equipment, or impair the functionality of the SBC+ Applications,
  • impersonate or misrepresent any third parties,
  • send or receive any material which is not civil or tasteful,
  • for any fraudulent purpose,
  • use posts in the forums to advertise goods or services,
  • breach these Terms and Conditions of Use.

6. Right to Terminate Account

We reserve the right to suspend or remove your registration if you do not comply with the above guidelines, in order to keep our services safe and reliable for other users.

7. Trademarks

All SBC+ names, service marks and logos used with our OTT service are the trademarks and service marks of the Seychelles Broadcasting Corporation. The SBC has made reasonable efforts to secure its intellectual property used in its applications.

8. Use of Content and Copyright

a) All material in the SBC+ Applications and Services, including (but not limited to) design, text, pictures, graphics, and all software compilations and underlying source code, are the copyright of the Seychelles Broadcasting Corporation with all rights reserved, either belongs to or is appropriately licensed by the SBC and should be treated as if belonging to the SBC.

b) Materials on SBC+ must not be copied, reproduced, published or republished, posted, uploaded, distributed or transmitted, modified, manipulated or reverse engineered.

c) Any use of the material on SBC+ must be for personal, non-commercial use

d) Any other use of materiel from our Application, including reproduction for purposes other than those stated above, publication, modification, sale, distribution, posting or transmission in any way without the prior written consent of the SBC is strictly prohibited

9. Competition

a) Eligibility and Entry Criteria

i) In order to make a valid entry into a competition you must enter as an individual using your legal name and make only one entry per competition, unless a specific rule allows you to make multiple entries.

ii) You may only enter a competition if you are registered to the OTT

iii) A specific rule for each competition will state if there are any age restrictions relating to that particular competition.

iv) Unless otherwise stated in a specific rule, you may not enter a competition on our Applications if you are an employee or family member of an employee, of (i) The SBC or (ii) any competition sponsor or prize giver or if you are directly or indirectly connected with the competition.

v) For us to ensure the fairness of our competitions, we reserve the right to prevent you, at our absolute discretion, from entering any of our competitions for a period of three months (Exclusion Period) if you have either (i) won a prize valued at Rs500 or greater or (ii) won more than one prize less than Rs500 during the previous three months. If we choose to exercise this right we will notify you in If you continue to enter our competitions during the Exclusion Period we reserve the right, at our absolute discretion, to remove prizes and impose a further exclusion period of twelve months from the date of your last entry attempt.

 vi)  You may not enter a competition if you have been given the answer(s) or any other relevant information in relation to the competition, either directly or indirectly, by any employee of The SBC, competition sponsor or a prize giver.

vii) No multiple, bulk, automated, machine assisted, third-party, syndicate or other group entries will be accepted. We shall disqualify any entries which, in our reasonable opinion, appear to have used any of these entry methods including multiple entries from the same IP address or telephone number, unless a specific rule state that multiple entries are permitted.

viii) We may ask you to provide us with proof of your eligibility to enter a competition and we reserve the right, in our sole discretion, to decide whether or not eligibility criteria have been met.

b. Entering a Competition

i) Entries by text message must be sent to the applicable short code as advertised on-air. Please be aware that short codes may change from competition to competition. You may need to check with your service provider for details of phone network compatibility. You will pay any text messaging charges via your service provider.
ii) Please take care to follow the exact on-air or online competition entry instructions. We cannot guarantee Competition entry for misspelt entries.
iii) A text message or a telephone call will normally cost the standard rate for your service provider. The cost of text messages and telephone calls via different service providers may vary, please check with your service provider for more details.
iv) If you are using a telephone which is not paid for by you, please ask for the permission of the bill payer before entering the competition.
v) If you fail to answer your telephone when we phone you or you become disconnected for any reason before or during the Competition, we reserve the right to select another entrant to participate in the Competition.
vi) For competitions involving online voting, only one vote for each valid email address or phone number will be accepted and we reserve the right to disqualify any entrant making, or attempting to make, multiple votes.
vii) If you are NOT residing in the Seychelles, you cannot enter competitions. If you do enter and win, you will be disqualified.

10. Links to Other Websites

a) The SBC+ Application may contain links to third-party websites. These links are provided solely for your convenience and do not constitute SBC’s endorsement of their content, for which SBC is not responsible in any way.

b) If you decide to access third-party websites through links in our App, you do so entirely at your own risk and your use of them is subject to the third-party’s own Terms and Conditions of Use.

11. Advertisements

a) The SBC and third-party advertisers may deliver advertisements for goods and services or other promotional materials via SBC+.

b) Your dealings with, or participation in advertisements and promotions of any third-party advertisers via our App service are solely between you and such third party and your participation is subject to the terms and conditions associated with that advertisement or promotion.

c) The SBC does not endorse or represent such third parties and by using SBC+, you agree that the SBC is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the actions of such third parties via SBC+.

12. Access outside of the Seychelles

a) The SBC+ platform is based in the Seychelles. SBC+ Applications and Services can be accessed from all countries around the world where the local technology permits.

b) Access to the content of the SBC+ may not be legal in certain countries.

c) If you access the SBC+ Applications and Services from outside the Seychelles, you do so entirely at your own risk and responsibility for compliance with the laws of your jurisdiction.

d) Recognising the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. In particular, you agree to comply with all applicable laws regarding the transmission of technical data which is exported from the country in which you reside.

13. Unforeseeable Circumstances

SBC+ is not liable for any delay, failure or interruption of its Applications or content delivery which is the direct or indirect result of any cause or circumstance that is beyond its reasonable control, including but not limited to failure of equipment or communication line, telephone or other interconnect problem, computer virus, unauthorised access, theft, operator error, bad weather or natural disaster, strike or other labour problem or governmental restriction.

14. Disclaimer

The SBC+ Applications and Services from the SBC is provided on an ‘as is’ basis.
The SBC makes no representation and gives no warranty of any kind, express or implied, as to the operation of its applications or the information, content, material, or services available from them, the accuracy, reliability, completeness or timeliness of the applications’ content or that the use of any applications will be uninterrupted, timely, secure or error-free.

You expressly agree that your use of the SBC+ Applications and Services is entirely at your own risk.

In no event shall the SBC be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits and damages resulting from the use or inability to use an application or its content) whether based on warranty, contract, tort or any other legal theory and whether the SBC is advised of the possibility of such damages.

15. Applicable Law & Jurisdiction

SBC+ can be accessed from all countries around the world where the local technology permits. As each of these countries have differing laws, by accessing SBC+ you agree that the laws of

the Republic of Seychelles without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of SBC+ Applications and Services.

You accept and agree that both you and the SBC shall submit to the exclusive jurisdiction of the courts of the Republic of Seychelles in respect of any dispute arising out of and/or in connection with these Terms and Conditions of Use.

16. Changes to the Terms & Conditions of Use

We may update our Terms & Conditions of Use from time to time.

We will notify you via email or text of any changes or by postingthenewTerms & Conditions of Use onthispagewithanotification.

These changes are effective immediately after they are posted on this page.

If you are not registered on the SBC+ service, you are advised to review this page periodically for any changes.

17. Consent

By using the SBC+ application and platform, you are consenting to our Terms & Conditions of Use, as set forth herewith and as amended by us in the future.
